HIGHWAY STAGE 8 EXTENSION — SECTION 18 APPLICATION
1408. Hon LYNN MacLAREN to the
Minister for Aboriginal Affairs:
I refer to Main Roads Western Australia's section 18
application in relation to Roe 8 and a ministerial written by the Registrar of
Aboriginal Sites about this application dated 10 June 2015.
(1) At the
time the minister approved the application, was he aware that the Aboriginal
Cultural Material Committee's original recommendation, made in February
2013, had been that the section 18 application should be declined?
(2) Was the
minister aware at the time of granting approval that Main Roads had not made
any changes to its application between February 2013 and June 2015?
(3) What
action did the minister take to examine and assess the ''information
provided by the Department of Aboriginal Affairs'' cited as the reason
for the ACMC reversing its position?

I thank the honourable member for some notice of the
question.
(1) Yes.
(2) Yes, I was
advised that the Aboriginal Cultural Material Committee had reconsidered the
original notice and associated documentation as submitted by the applicant,
Aboriginal heritage place assessments for DAA 3296 and DAA 4107, and an
assessment of the section 18 notice.
(3) I
considered all the material available in making my decision, including the
recommendation of the Aboriginal Cultural Material Committee, information on a
series of historical archaeological investigations and the general interest of
the community. The Department of Aboriginal Affairs' advice stated that
the Aboriginal Cultural Material Committee was satisfied that the applicant had
done everything possible to minimise the road footprint and impacts on the
Aboriginal sites and/or places on the land, considered that the better quality
information provided by the department afforded it greater clarity and believed
that procedural fairness had been adequately afforded to all parties with an
interest in the notice. I accepted the Aboriginal Cultural Material Committee's
recommendation to grant consent, subject to conditions.
