Firearms—Licences—Cancellation
1192. Hon Phil Twiss to
the minister representing the Minister for Police:
I refer to the
answer to my question without notice 1137 from 20 November, which revealed that
495 individuals had been subject to firearm licence revocations due to
mandatory disqualifying offences (MDOs).
(1) Will the minister provide a current list of
the offences for which the 495 individuals have been subject to revocation
based on MDOs, grouped by name of offence and number of revocation per type?
(2) How many of these MDOs have been appealed to
the State Administrative Tribunal?
(3) How many of these MDOs have been overturned by
the State Administrative Tribunal?
(4) As a result, how many licences have been
reinstated?

I thank the member
for some notice of the question. The following answer has been provided to me
by the Minister for Police.
(1) The Western Australia Police Force is unable
to provide a response to this question as this would require significant manual
interrogation that would divert significant resources away from operational
priorities. The next part of the answer is in tabular form, so I seek leave to
have that incorporated into Hansard .

disqualifying offence is;
A serious
offence as defined in the Criminal
Investigations Act 2006 s.128(1), attracting a minimum penalty of 5yrs
of more imprisonment.
An offence
under the Firearms Act 2024 sections 236, 239, 241, 243, 245(1), 247(1), 250,
252, 254(1), 256 or 300(1) or (2).
An offence
under the Weapons Act 1999, section 6A(1) or (2), 6B(1) or (2) or 7(1) or
(2);
An offence
under the Criminal Code, section 74, 186(1), 191(1), 192(1), 305(3), 338E(1)
or (2) or 407;
An offence
under the Misuse of Drugs Act 1981, section 8Q(1) or (2).
(2) There have been 23.
(3)–(4) There have been zero.
