I refer to the answer to Legislative Assembly Question on Notice 4963, and ask: (a) In the table listing contraband found following searches what does “other” refer to; (b) In respect to question response (h) (i)-(ii), can the Minister explain why an incident report was not submitted on the Total Offender Management System (TOMS) for the incident in question; (c) Would it be normal practice for an incident report to be submitted on the TOMS following a breach of prison security such as occurred on the day of my visit: (i) If not, why not; and (d) What is the general nature and thresholds of various incidents that would normally be submitted as incident reports on the TOMS?

(a) Appendix 1-Policy Directive 41 states “any other item that may place the security of the prison or any person under significant risk”.
(b) An incident report was not submitted on the Total Offender Management System (TOMS) as staff erroneously did not consider that it met the threshold for reporting. This matter was assessed by the Professional Standard Division’s Integrity and Accountability directorate. They did not identify suspected staff misconduct by Prison Officers which warranted any disciplinary action further to the local actions taken by the Superintendent. The following actions have been undertaken:
(c)  All staff should submit a Security Report where:
(d) Section  6.2 of Policy Directive 41 – Reporting of Incidents and additional notifications states that “An Incident Report must be submitted following every incident”. Section 5.1 provides some guidance as to what is an incidents:
5.1 An incident is any event that may:
• jeopardise the good order and security of the prison.
• jeopardise the safety or health of staff, prisoners, contractors or visitors.
• adversely affects the normal or routine operation of the prison.
• result in the loss of a privilege.
• result in a charge of a prison offence.
