BUILDING COMMISSION — COMPLAINTS —
SAAD SOLIMAN
1040. Hon ALANNA CLOHESY to the Minister
for Commerce:
I refer to question on notice 2994,
asked on 12 May 2015.
(1) Is the minister aware that —
(a) Mr Saad
Soliman is currently registered as a builder on the register of building
contractors and practitioners, registration number 10488?
(b) In June 2015
the Building Services Board imposed a condition on Mr Saad Soliman's
builders registration to restrict him from being a nominated supervisor of
another building company, partnership or body in which he owns shares, or is a director,
partner or member?
(c) At least 25
complaints have been made to the Building Commission against Mr Soliman
including, but not limited to, breach of contract, structural faults, standard
and quality of work, lengthy project delays and damage to existing property
dating back to 2008?
(d) The previous
companies under which Mr Soliman has traded include Benchmark Designer Homes,
In Residence, Baby Boomer Homes, Minaret Holdings Pty Ltd, Radical Home
Improvements, Perfections Investments Matrix Commercial Solutions, Advanced
Commercial Solutions, and Virtually Built? That was not ironic.
(2) Have all
restrictions placed on Mr Soliman by the Building Services Board in June 2015
since been removed?
(3) If yes to (2), why have these
restrictions been removed?
(4) If no to (2),
what has the Building Commission done to alert prospective home builders of the
extent of complaints regarding Mr Soliman?

I thank the honourable member for
some notice of this question.
(1) Although it
is unrealistic for me to be familiar with the registration status of each
registered building practitioner in Western Australia, I am advised 21
complaints have been recorded against Mr Soliman, 16 of which relate to
workmanship or contractual disputes and five of which relate to disciplinary
matters. I understand all those complaints are now settled.
(2)–(4) I
am advised that the independent Building Services Board imposed the condition
described in part (1)(b) of the member's question on Mr Soliman'
s building practitioner registration in June 2015. It also referred
disciplinary allegations to the State Administrative Tribunal on Benchmark
Designer Homes Pty Ltd and Mr Soliman in his role as director of the company.
In July 2016, the board decided it
was satisfied that the condition on Mr Soliman's registration as a building
service practitioner was no longer warranted and the condition was removed. The
disciplinary allegations concerning Mr Soliman's building contractor
registration were also resolved at this time. As the company registration had
expired, Mr Soliman no longer holds a building contractor registration. Mr
Soliman's current class of registration as a building practitioner does
not permit him to enter into contracts for building work; this can only be
undertaken by a registered building contractor. In the event Mr Soliman was to
apply for a building contractor registration in the future, the Building Services
Board would be able to take into account any relevant information for it to be
satisfied the registration requirements could be met.
