I refer to the
17 January 2014 Tidal Energy Australia (TEA) Compliance Assessment Plan by AECOM, and
section 2.0 - 2.1 Approach and Timing on page 3, and requirements of the audit
codes and stated commitments for M5.1 Public Availability of Data on page 10
that Subject to Condition 5-2, within a reasonable time period approved by the
Chief Executive Officer (CEO) of the issue of this statement and for the remainder of the life of the
proposal the proponent shall make publicly available, in a manner approved by
the CEO, all validated environmental data (including sampling design, sampling
methodologies, empirical data and derived information products (e.g. maps)
relevant to the assessment of this proposal and implementation of this
statement, and that the evidence would be available on the TEA Website, and ask: (a) can the Department of Environment advise if the evidence is available on the TEA website; (b) if no to (a), why is this evidence not available on the TEA website; (c) if no to (a), will the Minister instruct TEA to make the evidence available on the TEA website; (d) if no to (c), why not; and (e) if yes to (c), what action is available to the Minister if the TEA do not comply?

(a) The Tidal Energy Australia website contains the most recent up to date environmental information relevant to the proposal. Included in this information are relevant documents and data used in the assessment of the proposal.
The Office of the Environmental Protection Authority has recently requested the company, Tidal Energy Australia Pty Ltd, to place all other documents relevant to the assessment of the proposal on its website including its recent Compliance Assessment Report in accordance with the commitment made in its Compliance Assessment Plan.
As the project is yet to commence no information in relation to the implementation of the proposal is available.
