In respect of application 125353 for the subdivision of lots 253 and 7 Hamilton Street, Queens Park, the Commission imposed a number of standard conditions for the provision of services and infrastructure and added condition 15, which states: "Prior to ground disturbing activities a site investigation is to be undertaken to determine the extent of and severity of any potential contamination of the proposed lots to the satisfaction of the Western Australian Planning Commission. If as a result of this investigation the site is found to be contaminated, then a 'Site Remediation and Validation Report' is to be produced and implemented to the satisfaction of the Western Australian Planning Commission." (2) The Western Australian Planning Commission has not cleared the conditions relating to the subdivision. (3) No. The Minister for Planning and Infrastructure was not aware that the lots may be being offered for sale and the City of Canning has not advised the Minister of such activity. (Note: As the Contaminated Sites Act 2003 has not yet commenced, contaminated sites are managed via these guidelines) (7) Not applicable. (8) Planning approvals for the subdivision and development of land are issued under the Planning and Development Act and the Western Australian Planning Commission is responsible to impose and clear conditions. As the Department of Environment has the technical capability to provide advice in relation to contaminated sites, the Western Australian Planning Commission will await the advice of the Department of Environment prior to clearing the condition. (9) No. (10) The Site Remediation and Validation Report, confirming that the works have been undertaken, is being assessed by the Department of Environment, which will present its findings to the Western Australian Planning Commission. It is desirable that the environmental reports and management plans for the remediation of the site be requested from the proponent or, failing that, formally through the Department of Environment as is usual practice for such matters.
