COMMERCE — MUGARINYA COMMUNITY ASSOCIATION
747. Hon ROBIN CHAPPLE to the
Minister for Commerce:
I refer to question
on notice 3158 asked in the Legislative Council on Tuesday, 12 May 2015 to the
Minister for Aboriginal Affairs and question on notice 2851 asked on Tuesday,
10 March 2015 to the Minister for Commerce. According to the Department of
Commerce's website the Associations Incorporation Act 1987 requires an
association to keep certain documents, and the Commissioner for Consumer
Protection can request an association to produce any or all of the records listed
under the act.
(1) Given the recent concerns highlighted in
the questions asked regarding meeting procedures, will the department and/or
the minister request records of annual general meetings held by the Mugarinya Community
Association Incorporated?
(2) If no to (1),
why not?

I thank the
honourable member for some notice of this question.
(1) No.
(2) The Commissioner for Consumer Protection
can only require the production of records relating to an incorporated association
where there is evidence of either a failure to comply with the Associations
Incorporation Act 1987 or an offence relating to the incorporated association
that involves fraud or dishonesty or concerns about the management of the
affairs of the association. The acting Commissioner for Consumer Protection has
advised me that he currently has no such evidence in relation to the Mugarinya
Community Association Incorporated.
