I refer to the Irvine Island Mining Development and the commitments in the Project Explanatory Document for Referral prepared for Pluton Resources Ltd of August 2011, and ask -
(1) Is the Minister or Department aware of any activity occurring in the areas of very significant cultural heritage importance outside the identified footprint of the Pluton Proposal on Irvine Island?
(2) If yes to (1), on who's authority did this activity occur?
(3) If yes to (1), what is the nature of that activity?
(4) If yes to (1), were the Mayala traditional owners advised or consulted?
(5) If yes to (1), has the Minister or Department received any advice from any party or agency on this matter?
(6) If yes to (5), what was that advice and from whom did it come?
(7) Have any

2. This activity was the subject of a consent under section 18 of the
Aboriginal Heritage Act 1972
granted by the then Minister for Indigenous Affairs in November 2010.
3. Drilling of environmental monitoring bores within the central portion of E04/1172.
4. Yes, a submitted section 18 Notice included evidence of consultation with Mayala Traditional Owners.

6. A letter addressed to the Department of Indigenous Affairs (DIA) from the Bardi and Jawi Niimidiman Aboriginal Corporation (BJNAC) dated 30 July 2010 which objected to the development on Irvine Island was received by DIA from the Kimberley Land Council on 4 August 2010. The letter was withdrawn in writing by the BJNAC on 12 October 2011.
7. Yes, a section 18 Notice was lodged on 20 August 2010. The Notice was considered by the Aboriginal Cultural Material Committee on 6 October 2010 and Ministerial consent granted with conditions on 16 November 2010.
