TIDAL POWER STATION —ENVIRONMENTAL ASSESSMENT
617. Hon ROBIN CHAPPLE to the
minister representing the Minister for Environment:
I refer to the statement that a proposal may be implemented,
pursuant to the provisions of the Environmental Protection Act 1986, Derby
tidal power station project, statement 941 of 22 July 2013.
(1) Has the
proponent submitted to the CEO the compliance assessment plan required by
condition 4-1 at least six months prior to the first compliance assessment
report required by condition 4-6?
(2) If yes to (1), on what date was it submitted?
(3) If yes to (1), will the minister table a copy?
(4) If no to (1), why not?
(5) If no to (3), why not?
(6) If no to (1), does implementation of the proposal remain
in place?
(7) If yes to (6), why?

(1) Yes.
(2) It was submitted on 17 January 2014.
(3) No.
(4) Not applicable.
(5) The
compliance assessment plans provided under condition 4-1 of ministerial
statements are not public documents under the Office of the Environmental
Protection Authority's information statement but can be requested under
freedom of information. The freedom of information process provides opportunity
for the company that submitted the plan to notify of any objection to the
release of the plan and for any commercial-in-confidence information to be
redacted. It is therefore not appropriate for me to table the plan; however, a
freedom of information request can be lodged with the Office of the
Environmental Protection Authority.
