(1) Is the minister in possession of a legal opinion from barrister R.K.F. Davis dated 6 August 2001 that outlines undeclared pecuniary interests on behalf of a number of City of Kalgoorlie-Boulder councillors relating to the matter of council approval of the Eastern Bypass Road? (2) How does the minister intend to follow up this advice? Hon TOM STEPHENS

I thank the member for some notice of this question. (1) Yes. Apparently the opinion was received on 10 August 2001. I do not recall having received it and I certainly do not believe that I have had any exposure to it. (2) The advice was forwarded to the Department of Local Government and Regional Development. I will read the advice I have been given, although it does not make grammatical sense. It says that the acting director general of the department has, under the Local Government Act 1995, authorised inquiries into those alleged undeclared financial interests that the department has determined require further inquiry. I assume that is best interpreted as meaning the department has determined that the allegations about undeclared financial interests require further inquiry. On the basis of that determination, the acting director general of the department has presumably authorised that those inquiries be undertaken.
