review of native title and Aboriginal cultural heritage processes in Western
Australia.(1) Noting the terms of reference that explicitly
note the mining industry, will the review consider the impact of increasing
risks to semirural landowners, farmers and local governments, who appear to be
increasingly the target of prosecutorial actions by the Director General of the
Department of Planning, Lands and Heritage?(2) How many prosecutions are currently on foot
and will the minister please list the parties?(3) When was the last time the minister met with
the Director General of DPLH to discuss matters related to the review?

Hon Stephen Dawson replied:I thank the
honourable member for some notice of the question. I do not have the preamble
in the copy of the question that I have. However, the rest of the questions are
the same, so I will provide an answer.(1) The review will examine consultation processes
under current legislation and the capacity of stakeholders to participate in
these processes. It will focus on these processes as they relate to mining and
exploration.(2) Nil and not applicable.(3) The Department of the Premier and Cabinet is
the state government agency working with the National Native Title Tribunal to
deliver the review. The minister meets with the Director General of the Department
of Planning, Lands and Heritage regularly to discuss all matters relating to
Aboriginal heritage, including the review.
