I refer to the Premier’s bid to keep open the Burswood Dome, and ask - (1) Has the minister met with the Chairman of the Burswood Casino, Mr James Packer, and sought the continued operation of the Burswood Dome until the proposed new multipurpose stadium is completed? (2) What is the nature of the obligation, if any, under the Casino (Burswood Island) Agreement Act 1985 for Burswood Casino to continue to operate the Burswood Dome? (3) What will be the consequence to Burswood if it breaches the obligations specified in that act? (4) Does the government intend to offer Burswood Casino a financial incentive to offset the losses involved in continuing to operate the dome? I thank the member for some notice of this question. The minister submitted the following response - (1) The minister met with Mr Packer on 14 April 2005 on other matters. The minister has also recently undertaken a familiarisation tour of the Burswood Casino’s facilities, including the dome. (2) Clause 9 of schedule 1 of the agreement to the Casino (Burswood Island) Agreement Act 1985 requires Burswood Casino to maintain and operate the resort complex for the purpose for which it was constructed. (3) If Burswood demolishes the dome without amendment to the agreement, this will constitute a breach of the agreement, because there is no mechanism within the agreement for ministerial or state approval to demolish the resort complex or any part or stage thereof. If the state considers such default is material and not remedied, it may invoke part 6 of the agreement and by notice terminate the agreement. (4) No. (5) Not applicable.
