With regard to my letter to the Minister for the Environment dated 20 February 2004 about Newcrest Mining Ltd’s gas pipeline infrastructure corridor from Port Hedland to Telfer, I ask - (1) Can the minister provide a full break down on a day-to-day basis of the animal mortality in the open trench? (2) What action has the minister taken against the company? (3) Can the minister advise the level of staffing to handle the removal of animals from the trench? I apologise to the minister: there appears to be a part (4) in the question, which makes absolutely no sense to me! I do not know what happened there. (5) Can the minister advise whether any animals have died that are considered threatened under the Environmental Protection and Biodiversity Conservation Act? (6) Can the minister advise whether the open trench has now been infilled? (7) If yes to (6), can the minister advise when the work was completed? Hon TOM STEPHENS

I have available to me a reply from the Minister for the Environment that contains a long list of details in relation to the total count, total mortality and the percentage of mortality of animals found in the trench. Missing is their individual names! However, a large amount of other details is provided. I seek leave to have the fauna mortality information incorporated in Hansard as answer to question (1). The EPA published the review on 22 March 2004 recommending that the length of open trench be reduced from 60 kilometres to 20 kilometres to reduce the level of fauna mortality from the open trench. (3) The proponent employs six staff to walk the trench daily and to remove animals from the trench. The company also employs an environmental manager to oversee this process. (4) The unasked question reads: will the Government be seeking cost recovery from the company? The answer is that all costs related to this project are the responsibility of the proponent. If the question makes no sense, I hope the answer at least makes sense! (5) I have not been advised of any threatened species mortality. Such species are covered by the commonwealth legislation, and it is the responsibility of the proponent to notify Environment Australia if these species are likely to be impacted upon. (6) Yes, the proponents backfilled the existing 30 kilometres of open trench during Cyclone Monty - this was in order to prevent a rather lengthy lap pool forming out in the desert - from 27 February to 2 March in accordance with their commitments. The pipeline construction will be completed by approximately the end of April. (7) The Department of Environmental Protection has advised me that backfilling the open trench was completed by 2 March, excluding the trench in rocky areas as fauna can enter trenches in rocky conditions. Retrenching recommenced on 5 March.

Hon TOM STEPHENS replied: I have available to me a reply from the Minister for the Environment that contains a long list of details in relation to the total count, total mortality and the percentage of mortality of animals found in the trench.
(5) Can the minister advise whether any animals have died that are considered threatened under the Environmental Protection and Biodiversity Conservation Act? (6) Can the minister advise whether the open trench has now been infilled? (7) If yes to (6), can the minister advise when the work was completed? Hon TOM STEPHENS replied: I have available to me a reply from the Minister for the Environment that contains a long list of details in relation to the total count, total mortality and the percentage of mortality of animals found in the trench.
(7) If yes to (6), can the minister advise when the work was completed?

(1) Can the minister provide a full break down on a day-to-day basis of the animal mortality in the open trench? (2) What action has the minister taken against the company? (3) Can the minister advise the level of staffing to handle the removal of animals from the trench? I apologise to the minister: there appears to be a part (4) in the question, which makes absolutely no sense to me! I do not know what happened there. (5) Can the minister advise whether any animals have died that are considered threatened under the Environmental Protection and Biodiversity Conservation Act? (6) Can the minister advise whether the open trench has now been infilled? (7) If yes to (6), can the minister advise when the work was completed? Hon TOM STEPHENS replied: I have available to me a reply from the Minister for the Environment that contains a long list of details in relation to the total count, total mortality and the percentage of mortality of animals found in the trench.

(2) I issued a request to the Environmental Protection Authority on 15 March 2004 to immediately review the conditions of the project and to consider reducing the length of the open trench to 20 kilometres, in accord with national best practices advised by the Department of Industry and Resources to reduce the amount of fauna mortality.
