I refer to the issuing of T-class licences for recreational use in the Ningaloo Marine Park, and I ask —
(1) Is the Department of Environment and Conservation responsible for issuing a vessel named Aqua Rush a T-class licence to operate in the Coral Bay region of the Ningaloo Marine Park?
(2) If yes to (1), what kind of operation is this vessel allowed to operate under the terms and restrictions of this licence?
(3) If no to (1), who issued the licence?
(4) What licence conditions apply to this vessel with respect to the speed and environmental harm that it may cause within the Ningaloo Marine Park?
(5) What assurances does the Department of Environment and Conservation make that issuing T-class licences for use within marine park confines will not affect environmental values?
(6) What assurances does the Department of Environment and Conservation make that issuing T-class licences for use within marine park confines will not pose a risk to public safety within a recreation area?

(2) Boat tours or charters, diving, snorkelling and swimming, with access from the Coral Bay marine facility.
(3) Not applicable
(4) All the conditions within DEC's Commercial Operator Handbook - Marine as they apply to Ningaloo Marine Park plus the following conditions:
(a) When departing from and returning to the Coral Bay marine facility the operator shall take the most direct and safest route possible when traversing the Maud Sanctuary Zone. The operator shall not conduct any operations permitted pursuant to this licence, which includes boat tours, while within the boundaries of the Maud Sanctuary Zone and the Maud Sanctuary Zone Mooring Control Area.
(b) The operator shall comply with the Speed Restriction Area of five knots and eight knots within the Maud Sanctuary Zone (as gazetted by the Department of Transport).

(5)-(6) The licence conditions are consistent with the requirements of the Ningaloo Marine Park Management Plan.
