CRIMINAL INVESTIGATION ACT - MOVE-ON NOTICES
It has now been a little longer than one year since the Standing Committee on Legislation issued its report on the Criminal Investigation Bill 2005, the Criminal Investigation (Consequential Provisions) Bill 2005 and the Criminal and Found Property Disposal Bill 2005. One of the issues considered by the committee was the impact on the community, and particularly Aboriginal and Torres Strait Islander peoples, of move-on notices, which are now made pursuant to section 27 of the Criminal Investigation Act 2006. (1) Over the past six months, how many move-on notices have been issued to people who are Aboriginal or Torres Strait Islanders? (2) Of these, how many have been charged with breaches of the notice? (3) Over the past six months, how many move-on notices have been issued to people who are not Aboriginal or Torres Strait Islanders? (4) Of these, how many have been charged with breaches of the notice? (5) Over the past six months, how many move-on notices have been issued for a period longer than 20 hours? (6) Of these, how many have been charged with breaches of the notice? (7) Over the past six months, of the people charged with breaches of move-on notices, how many of these people were exposed to a potential penalty that was higher than that for the suspected conduct for which the move-on notice was issued? For the period 1-May 2007 to 31-October 2007 inclusive: 5,380 Move on notices were issued 2,721 (50.6%) Move on notices had no ethnicity recorded 2,659 (49.4%) Move on notices had ethnicity recorded 503 charges were prepared by WA Police for breaching move on notices 493 (98.0%) charges have ethnicity recorded 10 (2.0%) charges have ethnicity recorded as unknown (1) Of the 2,659 move on notices issued where ethnicity was recorded, 1,467 (55.2%) were issued to persons with a recorded ethnicity of Aboriginal or Torres Strait Islander. (2) Of the 493 charges resulting from breach of notice where ethnicity was recorded, 207 (42.0%) had a recorded ethnicity of Aboriginal or Torres Strait Islander (See Notes). (3) Of the 2,659 move on notices issued where ethnicity was recorded, 1,192 (44.8%) were issued to persons with a recorded ethnicity of non Aboriginal or Torres Strait Islander. (4) Of the 493 charges resulting from breach of notice where ethnicity is recorded, 286 (58.0%) had a recorded ethnicity of non Aboriginal or Torres Strait Islander (See Notes). (5) Of the 5,380 Move on notices issued, 1,724 (32.0%) were issued for a period longer than 20 hours.
