With regard to proposals for Leisure Projects Pty Ltd to extend the trading hours of the Boab Inn, Derby -
(1) Does the Minister support the views that ‘The Derby Local Drug Action Group is committed to reducing the harmful effects of substance abuse on individuals and families within the Derby community’?
(2) What does the Minister consider an acceptable level of alcohol consumption per adult in Western Australia?
(3) What is the level of alcohol consumption per adult in Derby and how does this compare with the State and National average?
(4) Does the Minister consider that this level of alcohol consumption is closely associated with serious levels of physical, mental, sexual and social dysfunction?
(5) Is the Minister aware that Marnum Bowa Dumbara, the Derby Family Healing Centre, reports that virtually all their clients present as a direct result of domestic violence occurring whilst one or both partners are intoxicated?
(6) Is it the Ministers understanding that the application is to extend trading for an extra hour on Wednesday to Saturday to 1.00am and that Sunday trading hours will be extended by an extra two hours from 10.00pm until midnight?
(7) Does the Minister support section 5(1)(b) of the
Liquor Licensing Act 1988
, which states as a primary objective of the Act; ‘To minimise harm or ill-health caused to people, or any group of people, due to the use of liquor’?
(8) Is the Minister aware that the Derby Local Drug Action Group, Lorna Hudson OAM (Order of Australia Medal), CM (Centenary Medal) and Chairperson of Burrinunga Aboriginal Corporation, are opposing extension of the trading hours?
(9) Does the Minister have concerns over this application by Leisure Projects Pty Ltd to extend the trading hours of the Boab Inn, Derby?
(10) If yes to (9), will the Minister advise the Liquor Licensing Commissioner of his concerns?
(11) If no to (9), why not?
(12) Does the Minister consider that the current hours of operation by the Spinifex Hotel maybe already excessive given the nature of alcohol related problems in the Derby community?

Furthermore, in a 2001 appeal to the Supreme Court on the grant of an extended trading permit, Justice Templeman stated, “The only question is whether, having regard to all the circumstances and the legislative intention, an extended trading permit is justified. In answering that question the Director has a wide discretion: it is a matter for him to decide what weight will be given to the competing interests and other relevant considerations.” With respect to the level of alcohol consumption in Derby, I am advised that the adult (15 years and over) per capita pure alcohol consumption for 2001/2002 was 21.46 litres in the Derby/West Kimberly local government area. The average adult per capita pure alcohol consumption for all local government areas in Western Australia was 14.05 litres in 2001/2002. The Australian Institute of Health and Welfare reported the adult per capita pure alcohol consumption for Australia in 1999/2000 was 7.8 litres.
