(a)               The Prohibited Behaviour Orders Amendment Regulations (No. 2) 2024 (Amendment Regulations) make a consequential amendment to the Prohibited Behaviour Orders Regulations 2011 (PBO Regulations) as a result of the passage of the Police Legislation Amendment Act 2024 (Amendment Act). The Amendment Act amended the Weapons Act 1999 , inter alia, to introduce a new category of ‘edged weapons’.
The Amendment Regulations insert new s6A of the Weapons Act 1999 , which relates to carrying or possessing an edged weapon, into Schedule 1 of the PBO Regulations. Schedule 1 prescribes offences which are taken to involve anti-social behaviour for the purposes of the Prohibited Behaviour Orders Act 2010 . Since Schedule 1 already included the carrying or possession of prohibited of controlled weapons, the addition of new s6A is appropriate and aligned to the policy of the Schedule.
(b)        The Western Australia Police Force was consulted prior to these amendment regulations being finalised.
(c)        No.
