I refer to an incident of unauthorised clearing which I understand occurred on May 28 2000 on tenements managed by Kalgoorlie Consolidated Gold Mines Pty Ltd where an unauthorised road was pushed through using earthmoving, mechanised equipment on a Registered Aboriginal site ‘Use and Benefit of Aborigines Reserve 24574’ -
(1) Was this a breach of any section of the
Aboriginal Heritage Act 1972

(2) If so, were prosecution proceedings implemented?
(3) If not, why not?
