YARA PILBARA NITRATES PTY LTD — ANNUAL
COMPLIANCE REPORT
1303. Hon ROBIN CHAPPLE to the minister
representing the Minister for Environment:
I refer to the ''Yara Pilbara Nitrates 2016 Annual Compliance
Report EPBC 2008/4546 February 2015–February 2016: Technical Ammonium
Nitrate Plant'', which is dated 6 October 2016.
(1) Why is condition 10 under section 3.2's
compliance table listed as ''modified � 18/12/2013 and 10/02/2014''
noncompliant?
(2) Why is condition 11, which is listed as ''modified �
18/12/2013'', not applicable?
(3) With reference to the variation to the
conditions attached to the approval document relating to Yara Pilbara Nitrates'
technical ammonium nitrate production facility, dated 18 December 2013 —
(a) is Yara Pilbara obligated to comply with
conditions 10 or 11, which relate to rock art monitoring on the Burrup
Peninsula; and
(b) has an exemption of this kind ever been
given under the Environment Protection and Biodiversity Conservation Act?
(4) Is Yara Pilbara Nitrates obligated to
carry out any kind of rock art monitoring on the Burrup Peninsula as part of
its approval conditions for either the liquid ammonia plant or the TAN
production facility?

I thank the honourable member for
some notice of the question. The Minister for Environment has provided me with
the following response —
(1)–(3) These
reports and conditions relate to an approval under the commonwealth Environment
Protection and Biodiversity Conservation Act 1999 and questions should be
directed to the federal Minister for Environment and Energy. It is the answer.
(4) There are no
rock art monitoring conditions for approvals granted under the Western Australian
Environmental Protection Act 1986.
