Following a detailed analysis of the implications of the High Court decision, the Government has been negotiating with the native title claimants and the other parties to the claim with a view to resolving the claim through agreement. This approach accords with the Government’s policy of resolving native title claims through agreement rather than litigation wherever possible. The claim covers a large area, including Kununurra and Lake Argyle, and raises a number of complex issues. However, real progress is being made in the negotiations and the parties have reached agreement on a number of significant issues. The Government is taking a holistic approach to the negotiations and is seeking to resolve the residential land shortage in Kununurra and native title and heritage issues associated with the proposed Ord Stage 2 initiative as part of a global settlement with the Mirriuwung and Gajerrong claimants. Aboriginal ownership of 50,000 hectares of land near the Northern Territory border, known as Yardungarll, will constitute an important part of the settlement package. (2) See above.
