representing the Attorney General:
I
refer to the Attorney General's response on 14 February 2023 to
question on notice 1103 in which he revealed that noncompliance with work and
development permits is recorded within the metric of the number of permits
cancelled.
(1) How many permits were cancelled
during the 2021–22 financial year?
(2) Noting that
permits can be cancelled for various reasons, including in circumstances in
which a sponsor is unable to continue supervising the performance or activity
stated in the permit, why is noncompliance of the offender not measured as a separate
metric?

I thank the member for some notice
of the question. I note that the answer was correct as at 21 February 2023. The
following information has been provided to me by the Attorney General.
(1) Between 1 July 2021 and 30 June
2022, the total number of permits cancelled was 641.
(2) Section
46H(4) of the Fines, Penalties and Infringement Notices Enforcement Act 1994
specifies the grounds on which a work and
development permit may be cancelled by the registrar of the Fines Enforcement Registry. The department therefore maintains data on permit cancellations
specifying which of those legislative grounds are applicable.
