EMERGENCY
MANAGEMENT AMENDMENT (TEMPORARY COVID-19 PROVISIONS) ACT
651. Hon NICK GOIRAN to the Leader of the House representing
the Premier:
I refer the Premier to his predecessor's responses to
the Legislative Council, through question time and to a parliamentary committee, regarding the Emergency Management Amendment
(Temporary COVID-19 Provisions) Act 2022, which was described by former
Commissioner of Police O'Callaghan as lazy legislation.
(1) Is the
Premier aware that his predecessor wrote to the Standing Committee on
Environment and Public Affairs on 4 May 2023 stating that provisions in the act
will automatically expire two years following the commencement of the act?
(2) Is the
Premier aware of the date in 2024 that these provisions are set the expire?
(3) If yes to (2), what is that date?
(4) In light
of the equivocal response provided by his predecessor, will the Premier
unequivocally commit to not extending these new powers when they expire?

The provisions referred to by the member automatically expire on 3 November
2024, two years following the commencement of the act. The provisions cannot be
extended by the Premier.
