2013 meeting minutes relating to the ACMC's resolution to decline
consent to the Roe 8 section 18 application, did the ACMC executive officer
prepare a briefing note for the minister on the resolution?
(2) If no to (1), why not?
(3) If yes to (1), please table the briefing note.
(4) What is
the minister's response to the South West Aboriginal Land and Sea
Council's statement this week that, having conducted extensive
consultation with the Whadjuk people native title claimants and the Noongar
community, SWALSC confirms that there is steadfast opposition to the proposed
Roe 8 extension and that no amount of conditions or measures can mitigate the
loss of significant heritage and spiritual connection to the Coolbellup and
Walliabup area wetlands, also known as North Lake and Bibra Lake?

I thank the honourable member for
some notice of the question.
(1)–(2) No.
However, I received a briefing note from the director general of the Department
of Aboriginal Affairs, in May 2013 advising that I was constrained from making
a decision regarding the proposal under the Environmental Protection Authority's
process, and therefore the section 18 notice and the Aboriginal Cultural
Material Committee's recommendation would not be forwarded to me until
notification is received from the Minister for Environment.
I thought I had
answered this yesterday, actually.
(3) Not
applicable.
(4) I understand
and recognise the importance and significance of the North Lake and Bibra Lake
area to the traditional owners. Under section 18(3) of the Aboriginal Heritage
Act 1972, when the Aboriginal Cultural Material Committee submits a notice to
me under subsection (2), I have to consider its recommendation and have regard
to the general interest of the community. I accepted the recommendation by the
Aboriginal Cultural Material Committee to grant consent, subject to conditions.

did answer a very, very similar question to this just yesterday.
