My question regards the tearing down of buildings at the Swan
Valley Nyungah Community, which took place on the morning of Tuesday, 18 March
2014.
(1) Did the Minister for Planning obtain a section 18 under
the Aboriginal Heritage Act 1972?
(2) If no to (1), why not?
(3) Was the
minister aware that the sacred dome is located on Pyrton land and not on the
land addressed in the switch of land from the Western Australian Planning
Commission to Department of Parks and Wildlife?
(4) If no to (3), why not?
(5) When did the department notify the City of Swan about the
demolition order?
(6) Will the
minister table the correspondence from the department to the City of Swan
advising of the demolition order?
(7) If no to (6), why not?

no requirement for a section 18 approval as the land does not fall within the
meaning of section 5 of the Aboriginal Heritage Act 1972
(3) Yes.
(4) Not applicable.

The demolition permit was issued by the Building Commission and the Building
Commission notified the City of Swan.
(1) No.
(2) There was
no requirement for a section 18 approval as the land does not fall within the
