(a) In the 1998 Teacher's Certified Agreement the Education Department agreed to reduce class sizes in Years 1-3 to 28 for the period 1999 - 2002 and to 24 in 2003. An Explanatory Memorandum was produced at the time of the 2000 Agreement and was placed on the Department’s website along with the Government School Teachers’ and School Administrators Certified Agreement 2000 which outlined, amongst other matters, reductions in class sizes in Years 1-3. Schools were advised in a letter dated 11 July 2002 from the Director General that schools would be resourced so that no Year 1-3 class need have more than 24 students. A letter of clarification, jointly signed by the Director General and the President of the State School Teachers Union, was sent to District Directors and principals of primary and district high schools on 16 September 2002. Further, schools were advised of the employment of an additional 350 teachers to facilitate the reduction in class sizes in a letter of 19 September 2002 from the Director General regarding changes to the K – 12 Teacher Staffing Formula. No policy documents or guidelines were provided to schools.
