The Employment Protection arm of the Department of Consumer and Employment Protection (DOCEP) has advised the Minister for Employment Protection that, in respect of the Employment Protection arm of DOCEP:

Mine Safety and Inspection Act
, which is administered by the Department of Consumer and Employment Protection, is primarily concerned with the occupational safety and health of workers employed in mines and mining operations.
The Act places a duty on employers at a mine to ensure, so far as practicable, that the safety or health of a person who is not an employee of the employer is not adversely affected as a result of work undertaken by the employer. The matter of fly rock from surface mining operations is specifically dealt with at Regulation 8.30 of the Mines Safety and Inspection Regulations 1995. Responsibility for compliance with the Regulation lies with either the "responsible person" as defined in the regulations or the manager of the mine.
