The Minister for Environment has provided the following response.
(1) Yes
(2) The Department of Environment Regulation (DER) has determined that there is no basis to continue to exclude grain loading and unloading from regulation under the
Environmental Protection Act 1986
.

(6) DER has attended and observed the grain loading operations at Bunbury Port on two occasions. Further inspections are required to determine the normal operating conditions of the grain loading facility under all wind conditions, the adequacy of dust management measures and what, if any, improvements are required. DER's assessment will be completed as soon as a sufficient number of ship loading events have been observed under a range of weather conditions.
