I refer to a media statement dated August 24 2004 titled ‘Government responds to the Cooke Review’, a letter from myself dated November 3 2003 addressed to the Hon Clive Brown MLA, Minister for State Development, titled ‘Cooke Review’, and the Government’s response to the Final Report of the Cooke Review tabled in Parliament on the August 24 2004 -
(1) Will the review of the Fimiston I tailings dam investigate and specifically make comment in accordance with the terms of reference whether the Government Agencies have allowed the owners or operator, Kalgoorlie Consolidated Gold Mines Pty Ltd, to breach mining tenement conditions on Mining Lease 26/383, or any other tenements, specific licence conditions on works approval applications, and also conditions of licence on the Fimiston I tailings dam since the dam was first designed and constructed in 1988 up to present day?
(2) If no to (2), why not?
(3) If yes to (1), can the Minister quote the specific text of the terms of reference for the Fimiston I tailings dam which clearly permits this?
(4) Can the Minister state on what date was conflicts of interest or perception of conflicts of interest raised with the Minister’s office concerning the appointment of Mr Fred Baynes and Mr David Brett, with Mr Fred Baynes having worked with Golder and Associates from 1994-1996 given that Golders have been engaged by Kalgoorlie Consolidated Gold Mines Pty Ltd since early 1993 through to 2004 working on their tailings dams and other projects?
(5) If no to (4), why not?
(6) Can the Minister explain why an independent hydrological and geo-technical review was not commissioned by the Government prior to the Cooke Review commencing on the Fimiston I and Fimiston II tailings dams?
