REPEAL
974. Hon LYNN MacLAREN to the Minister
for Planning:
(1) Are there any plans to repeal
the Port Kennedy Development Agreement Act 1992?
(2) Under the existing act, is it
possible to build housing on land originally set aside as a golf course?
(3) Can the
minister please advise when public facilities that were planned to be an
integral part of the Port Kennedy development, such as the town centre and
multipurpose cultural centre, will be built?
(4) Does the
minister agree that, 24 years since the original act was passed, the Port
Kennedy development has not met its public amenity commitments and represents a
planning failure?

of the question.
(1) Yes.
(2) No.
(3)–(4) Elements of the Port Kennedy project have been
implemented, including some residential development and public works. However,
the overall project as envisaged in 1992 is no longer viable due to a range of
matters, including policy requirements for coastal setbacks and commercial
considerations. A normalised project agreement is, however, currently under
negotiation. As part of any agreement, additional public works would be
delivered on an agreed time frame by the developer, with their delivery
protected by bank guarantees. The Department of Planning, on behalf of the Western
Australian Planning Commission, is working with the project proponents to
progress this agreement.
