I refer to the statutory review of the Guardianship and Administration Act 1990 which was finalised in November 2015, and the Final Report of the Select Committee into Elder Abuse (Final Report) which was published in September 2018, and I ask: (a) is the Attorney General aware that by way of letter dated 26 April 2018, the then Attorney General, Hon John Quigley, advised that the then Western Australian (WA) Labor Government supported 77 of the 86 recommendations contained in the statutory review; (b) does the new Attorney General and the current WA Labor Government support those 77 recommendations; (c) is the Attorney General aware that the same Government responded to the Select Committee’s Final Report stating that “as per the McGowan Government [2017] election commitment, the Government has committed to expedite the enactment of amendments set out in the recommendations of the Statutory Review”, and that a bill would be introduced in the first half of 2019; (d) given that around 3000 days have passed since Labor’s election commitment was made in 2017, does the Cook Labor Government still intend to introduce such a bill; and (e) if yes to (d), is it intended to be introduced in this calendar year?

On 15 April 2024, the former Attorney General referred the Guardianship and Administration Act 1990 (WA) (Act) to the Law Reform Commission of Western Australia to review, provide advice on and make recommendations for new legislation to enhance and update the Act.
The Law Reform Commission is considering the need for legislative reform in the context of the recommendations of the Royal Commission into Violence, Abuse, Neglect and Exploitation of People with Disability, the Final Report of the Select Committee into Elder Abuse, the work of the Standing Council of Attorneys General and other, related developments occurring in other Australian jurisdictions.
The Law Reform Commission is due to provide its final report on its review of the Act this year.
