For those Agencies under the Minister’s control, for the 2008-09 financial years can the Minister advise, -
(1) How many ‘appropriate authority investigations’ into alleged misconduct were conducted by Agencies under your control?
(2) Of the total, how many are complete?
(3) What was the finding from the investigation?
(4) Was a report done on each of those investigations?
(5) If no to (4), why not?
(6) Were these reports made public?
(7) If no to (6), why not?
(8) How many investigations are still ongoing/outstanding?
(9) What is the nature of the investigations?

Public Transport Authority
(1) 81 investigations were conducted into alleged misconduct in accordance with the "Public Transport Authority Investitation Procedures".
(2) All are complete.
(3) Findings are determined as either substantiated or not substantiated. Of the 81 alleged misconduct investigations undertaken for the 2008-09 financial year, 29 investigations were found to be substantiated.
(4) Yes.
(5) Not applicable.
(6) All investigation reports were submitted to the Corruption and Crime Commission (CCC) in accordance with their Act. Any release of information to the public is a matter for the CCC to determine.
(7) Not applicable.
(8) None.
(9) The investigations related to:
Excessive use of force.
Breach of policy.
Unlawful arrest.
Sexual assault.
Fraud.
Abusive behaviour.
Misuse of motor vehicle.
Main Roads
(1) One.
(2) One.
(3) No misconduct on the part of any public officer. Certain matters (outside CCC jurisdiction) were referred to the Ombudsman.
(4) Yes.
(5)-(7) Not applicable.
(8) As per (3).
(9) Administration and enforcement of heavy vehicle permit regulations.
Department of Transport
(1) The Department of Transport conducted 13 investigations into 13 alleged breaches of the WA Code of Ethics and/or the Department of Transport's (formerly the Department of Planning and Infrastructure) Code of Personal Conduct during the 2008-09 period.
(2) Six investigations were completed during 2008-09. The other investigation was completed in August 2009.
(3) The findings of the investigations led to seven formal reprimands being issued.
(4) Yes.
(5) Not applicable.
(6) No.
(7) There is no obligation to make the results of the investigations public under the
Public Sector Management Act 1994
.
(8) Six.
(9) The Corruption and Crime Commission and Western Australia Police investigations are continuing, and I am not able to advise of the investigation findings as the process is still ongoing.
