In relation to Minim Cove, a very important Spiritual and Cultural Waugal site, and where there was no Section 18 application or consent to damage, alter, disturb and excavate a registered Aboriginal site by housing development, I ask the Minister -
(1) Will he pursue a prosecution of the Town of Mosman Park for breach of the
Aboriginal Heritage Act
in relation to Minim Cove on the Swan River?
(2) Is he aware that the jetty at Minim Cove was consented to excavate, destroy, damage and alter an Aboriginal Site by the Minister under the previous Government under Section 18 of the
Aboriginal Heritage Act
, against the unanimous objections of Nyungah Elders and Native Title claimants?
(3) Will he take action to remedy this situation?
(4) What arrangements will he put in place to ensure that Nyungah Elders and Native Title claimants Culture and Spiritual Dreaming is not over ridden in the future?

(2) The Minister is aware that the Minister for Aboriginal Affairs under the previous government granted consent for the building of the jetty at Minim Cove, pursuant to section 18 of the Aboriginal Heritage Act 1972 (AHA). The Minister is aware that there were objections to the proposal, by Nyungah Elders, but is not aware that these objections were unanimous. (3) It is unclear which situation this question refers to, and therefore, it is unclear what “remedy” is suggested. (4) Arrangements to ensure that consultation occurs with appropriate Indigenous people in relation to requests for consent to use land containing Aboriginal sites pursuant to section 18 of the AHA are already in place.
