In relation to Lake Claremont (formerly known as Butlers Swamp) where there was no Section 18 application or consent to damage, alter, disturb and excavate a registered Aboriginal site by Claremont Town Council for earth works in the lake, I ask the Minister -
(1) Has the Department of Indigenous Affairs reported to you the results of their investigation into why there was no Section 18 application granted before the Claremont Town Council commenced earthworks at Butlers Swamp?
(2) If no, when do you expect the Department of Indigenous Affairs to report?
(3) If yes, what are the results of the Department of Indigenous Affairs investigations into this matter?
(4) What action will the Minister take to ensure that Section 18 of
Aboriginal Heritage Act
is upheld in the future?
