I refer to the decision of the Metro Central
Joint Development Assessment Panel (JDAP) on 10 March this year which approved
a high-density apartment block at 94 Kitchener Road in Alfred Cove and
ask: (a) is the Minister satisfied that
the JDAP made a correct planning decision given the Melville City Council
determined the application as non-compliant and if so, for what
reason; (b) for what reason was this
application approved given the recommendation of the Council, the unanimous
vote of Melville City Councillors supporting that recommendation and the
significant level of valid planning objections from local residents;
and (c) is the Minister satisfied that
the JDAP’s decision to approve the application will not have an adverse impact
on the amenity of the surrounding area which is predominantly R20 zoned and, if
so, for what reason?

(a) The Joint Development Assessment Panel (JDAP) is an independent planning decision maker. The application went through a thorough assessment, including a mediation process through the State Administrative Tribunal (SAT). The JDAP determined the application in accordance with the City of Melville Community Planning Scheme No. 5, which contains discretionary powers under clauses 4.2 and 7.8 that allow the decision making authority to approve a development which does not comply with a standard in the scheme or a specific requirement in policy.
(b) Through the SAT mediation process, a modified proposal was prepared which was granted approval. The modifications addressed ten matters of concern that were outlined in the Responsible Authority Report of 20 February 2014.
(c) I am advised the JDAP did consider the amenity of the surrounding area, and approved the amended plans and the conditions of approval to ensure the amenity of the locality is not adversely affected.
