I refer to the
Environmental Protection Act 1986
licence dated June 13 2005 addressed to the Manager, Kanowna Belle Gold Mines -
(1) Is it correct that condition W9 (a) states ‘The Licensee shall not exceed a level of 0.50mg/L of weak acid dissociable cyanide for any water samples drawn from designated monitoring bores’?
(2) If no to (1), will the Minister quote the specific text of the condition?
(3) Can the Minister explain what environmental value or what specific part of the environment is the Department specifically seeking to protect by requiring the licensee to not exceed a level of 0.50mg/L of weak acid dissociable cyanide from any water samples drawn from designated monitoring bores given that the groundwater is hypersaline can be argued to be of no beneficial use except for mineral processing, and birds and animals apparently do not drink hypersaline groundwater?
(4) If no to (3), why not?
(5) Is it correct that condition W9(b) states ‘The Licensee shall advise the Goldfields Region Office in writing within 7 days of becoming aware of the results from any water samples drawn from designated monitoring bores which fall outside of the following criteria:
(1) pH in the range of 2 to 3.5 for GWMB1 to GWMB7;
(2) pH in the range of 3 to 5 for GWMB8 to GWMB11.’?
(6) If no to (5), will the Minister quote the specific text of the condition?

Environmental Protection Act 1986
for the Department to firstly require that water samples be taken from designated monitoring bores for pH levels and to ensure that if the results fall outside the criteria in condition W9(b) that they are reported to the Goldfields Regional office given that the groundwater is hypersaline and can be argued to be of no beneficial use except for mineral processing?
(8) Can the Minister explain how does the pH level of the groundwater samples as per licence conditions taken affect or potentially affect the hypersaline groundwater which can be argued to be of no beneficial use except for mineral processing?
(9) If no to (8), why not?
(10) Can the Minister explain how does the Total Dissolved Solids (TDS) level of the groundwater samples taken affect or potentially affect hypersaline groundwater which can be argued to be of no beneficial use except for mineral processing?

(3) Prior to 2003 the Department of Environment (then known as Department of Environmental Protection) sometimes used licence conditions to try and reflect best practice rather than focusing on protecting the environment from pollution or environmental harm. This condition is a reflection of the type that is attempting to promote good environmental practice and to ensure that the Department is aware where seepage is occurring and needs to be managed. (4) The Department of Environment is undertaking a licence reform program, which is the implementation of the recommendations of the Welker Review of 2003. This premise is yet to be considered in light of that program. With approximately 850 licensed premises in the State this review will take some time to complete. In the Goldfields area, the Kanowna Belle licence is likely to be reviewed in late 2006. (5) Yes. (6) Not applicable.
