I refer to the Office of the Environmental Protection Authority (OPEA) and ask: (a) when did the OEPA commence reviewing and revising the State Environment (Cockburn Sound) Policy 2005 and when will it be released for public comment; (b) is it correct that the State Environmental (Cockburn Sound) Policy 2005 is not enforceable at law; and (c) if yes, has the Government any plans to make the policy enforceable?

(a) The Environmental Protection Authority commenced the review of the State Environmental (Cockburn Sound) Policy 2005 in early 2012. A draft revised policy document and accompanying technical document were available for public comment from 20 November 2013 until 24 January 2014.
(b)-(c) The State Environmental (Cockburn Sound) Policy 2005 is not a statutory instrument. The policy provides an environmental management framework that is implemented by the multi-stakeholder Cockburn Sound Management Council. Any legal requirements are imposed through licensing under part V of the Environmental Protection Act 1986 or Ministerial conditions applied to significant proposals.
