However, when the previous Government handed over management of the freight track to WestNet Rail it did not stipulate that the provision of the warden must continue. Earlier this year WestNet Rail removed this service but was reinstated at the direction of the Director General of the Department for Planning and Infrastructure, under the Rail Safety Act. The direction to WestNet Rail was that it had to reinstitute the warden and maintain such operation unless it could submit a proposal supported by a risk assessment showing some other scheme would suit safety expectations for anyone crossing the railway at that location. Under the terms of the privatisation of Westrail Freight the future of the Argyle Street crossing is a matter for WestNet Rail. However, following discussions between my office and the company, I am very confident that WestNet Rail will continue to keep the crossing open and continue to provide a warden at the crossing.

(a)-(f) Prior to the sale of Westrail Freight by the Court Government, Westrail provided a warden at the Argyle Street rail crossing at school times. This service has continued to be provided by WestNet Rail since the sale of Westrail Freight.
