813. Mr B.S. WYATT to the
Premier:
I refer to the inclusion of the Kwinana Bulk Terminal as a
possible component of settling legal action with Mr Buckeridge.
(1) Which
government agency is leading the negotiations with James Point Pty Ltd?
(2) Which
government agency is providing instructions to the State Solicitor's
Office in respect of the litigation?
(3) Have any
valuations of the Kwinana Bulk Terminal been done by any agency of the state
government; and, if so, which one?
(4) I ask for
the sixth time: who proposed the idea of selling the Kwinana Bulk Terminal to
Mr Buckeridge as part of the settlement of the legal action?

A number of government agencies are involved, but Transport would be the lead
agency in those issues, given that it relates to a port.
Mr B.S. Wyatt : And both with advice to
the State Solicitor?
Mr C.J. BARNETT :
The State Solicitor obviously provides advice to government on this. As I have
said on several occasions now, this is part of a mediation process through the
Supreme Court. As a government, we are letting that Supreme Court process
continue. We do not know what will come out of it. One of the issues obviously
being talked about is the Kwinana Bulk Terminal. It is all right by government
that that be talked about in the negotiation. I am sure, if there is any final
mediation, valuations and the like will be done.
Mr B.S. Wyatt : So
none has been done yet.
Mr C.J. BARNETT : I
did not say that. As a government, we are not directly involved in the
mediation. We are letting it take place on government —

The mediation is being done through the Supreme Court.
Mr W.J. Johnston interjected.
Mr C.J. BARNETT :
It is. There are confidentiality provisions laid down by law relating to that.
Transport is the prime agency from a Western Australian government point of
view. I am not directly involved. The mediation process takes place in
confidence. We will let that process go on. As I and the Minister for Transport
have said on several occasions, if a settlement is agreed to by the parties
following this mediation, it may or may not include the Kwinana Bulk Terminal.
At this stage we do not know, and we will allow the mediation to continue.
