(1) Section 3(1) of the
Corruption and Crime Commission Act 2003
(WA) defines "
appropriate authority
" as meaning:
".... a person, body or organisation who or which is empowered by a law of the State to take investigatory or other action, or both, in relation to misconduct, but does not include an independent agency or either House of Parliament".
An "
independent agency"
means:
"(a) the Parliamentary Commissioner;
(b) the Director of Public Prosecutions;
(c) the Auditor General;
(d) the Inspector of Custodial Services; and
(e) the Commissioner for Public Sector Standards"
(as defined under section 3(1) of the
Corruption and Crime Commission Act 2003 (WA)
)
An
'appropriate authority investigation'
is investigatory action undertaken by an appropriate authority.
Such investigations differ from Commission investigations because they are conducted by the authority concerned using the processes and powers available to it.
(2) Of the 1,989 appropriate authority investigations monitored by the Commission in the 2008-09 financial year, the top five appropriate authorities were as follows:
Department of Education (383)
Department of Corrective Services (308)
Department of Health (229)
Department of Child Protection (141)
WA Police (132)
(3) The Commission's monitoring of appropriate authority investigations is reported to the public in Commission Annual Reports, for example at pages 5 and 25 of the 2008/2009 Annual Report.
