(1) How many Section 18 applications re the
Aboriginal Heritage Act 1972
(the Act) has the Aboriginal Cultural Materials Committee (ACMC) processed since that question was asked?
(2) Since that time, how many Section 18 applications recommended by the ACMC have been approved?
(3) Since that time, how many Section 18 applications recommended by the ACMC have been refused?
(4) How many Section 18 applications (re the Act) have the Government Ministers approved since the previous question was asked?
(5) How many Section 18 applications have the Government Ministers refused since the previous question was asked?
(6) Since the question was asked, how many times has the ACMC recommended a Section 18 application be refused and the Government Ministers have overridden this recommendation and approved the application?
(7) Will the Minister describe the nature of any such cases as listed in (6)?
(8) Since question on notice 1921 was answered, how many prosecutions under the
Aboriginal Heritage Act 1972

With respect to the years 2004 to 2007, the information requested is not readily available. Provision of this information would require considerable research which would divert staff away from their normal duties and I am not prepared to allocate the State's resources to provide a response. If the member has a more specific inquiry, I will endeavour to provide a reply.

Aboriginal Heritage Act 1972
:
(a) Prosecuted Mr Smith for disturbance of Sam's Creek burial site DIA 27561.
(b) Prosecuted Westralia Airport Corporation for disturbance of Airport: Boronia/Phillips site DIA 4001.
(c) Prosecuted Mr Kaplan for disturbance of Trotman's Cave site DIA 12053.
