I refer to Ministerial Condition 6 of the Ministerial Statement 641 of 4 December 2003 approving the Forest Management Plan 2004 – 2013 ('FMP') (that the FMP have the 'addition of a requirement for the immediate implementation of indicative fauna habitat zones') and the statement at page 14 of the Conservation Commission's end-of-term audit into the FMP that 'The finalisation of fauna habitat zones has been progressively completed on a priority basis, with approximately 100 out of 283 having been finalised by February 2012', and I ask —
(1) Have you/your department obtained legal advice as to whether Ministerial Condition 6 has been breached?
(2) If no to (1), why not?
(3) If yes to (1), what steps have you/your department taken subsequently?

(2) Condition 3-1 (6) required that the Forest Management Plan 2004 - 2013 include a requirement for the immediate implementation of fauna habitat zones. That requirement was met by the inclusion of proposed action 7.4 on page 28 of the plan which states:
7.4 The Department and Forest Products Commission will conduct their operations in indicative fauna habitat zones, and in fauna habitat zones established under Appendix 4 and the Guidelines for the Selection and Management of Fauna Habitat Zones:
7.4.1 in a manner that has regard to the requirements set out in Appendix 4, where the operation occurs prior to the approval of the Guidelines; and
7.4.2 in accordance with the Guidelines after they are approved and supercede Appendix 4.
