❓ Dr. Constable asks the Minister for the Environment and Heritage for a breakdown of environmental law non-compliance complaints received by the DEP from 2000-2003. The Minister's response indicates difficulty in providing specific data due to limitations in the DEP's data management system at the time, but provides data on Tier 1, 2 and 3 offences.

The DEP is unable to separate the above complaints into those relating to specific non-compliances with environmental law without going through each individual report and making a judgment as to whether the report relates to an environmental offence. A new integrated pollution incident database has been developed and is being used by the DEP central office now. Once the system has been fully developed, and integrated with the proposed enforcement actions database, it will be adopted across the agency, which in future will make responding to such questions as these much easier. (2) All complaints were investigated by the DEP or referred to other appropriate departments after screening. (3) It is important to note that the above figures represent a broad range of complaint types including many nuisance issues. Hence the vast majority do not result in specific enforcement action. Tier 1 and Tier 2 offences - charges (complaints) laid: 1999 - one, contravention of licence conditions 2000 - nil 2001 - one, failure to take all reasonable and practicable measures to prevent or minimise the discharge of waste 2002 - three cases (6 charges in total) of failure to comply with licence conditions; one charge of causing pollution; one charge of unreasonable emission 2003 - to date, one charge of causing pollution Tier 3 offences - penalties imposed for breaches of environmental protection regulations: 1999 - six $250 penalties; one $500 penalty 2000 - eight $250 penalties; two $500 penalties 2001 - one $500 penalty 2002 - nine $250 penalties 2003 - to date, two $250 penalties; one $500 penalty Enforcement actions taken by local government and Police under the Environmental Protection Act 1986 are not included in this response.
