528. Hon SUE ELLERY to the Leader of the House representing
the Premier:
In Parliament on 9 August 2012, the
Premier stated that Burswood has an entitlement to purchase an additional 10
hectares of land.
(1) Under what
clause of the Casino (Burswood Island) Agreement Act 1985 does Burswood have an
entitlement to acquire an additional 10 hectares of land?
(2) On what date
did Burswood officially notify the government of its intent to exercise the
entitlement to purchase the additional 5.8 hectares of land?
(3) In Burswood's
notification of intent to exercise its entitlement to purchase the 5.8 hectares
of land, did Burswood have estimations done of the value of the land; and, if
so, what were those estimations?

(1) Schedule 4, clause 6(5) of the
Casino (Burswood Island) Agreement Act states —
(5) Notwithstanding
the provisions of the Public Works Act
1902 , the Financial Administration
and Audit Act 1985 or of any other Act the State may —
(a) on the
recommendation of the Minister cause part or parts of any land excised from the
Resort Site not exceeding in the aggregate 10 hectares to be granted or leased
to the Trustee on terms and conditions approved by the Minister by notice
published in the Government Gazette ;
Further, under clause 23(3) —
Without affecting the obligation of
the Trustee under sub-clause (1)(c) the State shall be at liberty to:
(aa) excise from
the Resort Site any part or parts of the Resort Site agreed to be granted or
leased to the Trustee under clause 6(5);
(a) excise from
the Resort Site any part or parts thereof which may from time to time be
reasonably required for public streets or for the purpose of providing services
or facilities of like or similar kind to those referred to in clause 9(4) or,
with the agreement of the Trustee, for any other purpose, provided that the
area or aggregate of the areas so excised shall not without the consent of the
Trustee exceed —
(i) 10% of the
area of the Resort Site as at January 1986; or
(ii) 10% of the
aggregate of the area of (A) the Resort Site at the time of excision; and (B)
any land which has been excised from the Resort Site pursuant to paragraph (aa)
whichever
area is the greater;
(2) On 13 January2012.
