I refer to the Mental
Health Amendment (Psychiatrists) Bill 2012 and the minister's second
reading speech made on 24 October 2012.
(1) What culturally and linguistically
diverse training do psychiatrists who are employed in authorised hospitals in
Western Australia receive?
(2) What training do psychiatrists who are
employed in authorised hospitals receive in relation to their legal obligations
under the Mental Health Act?
(3) Have all of the more than 25
overseas-qualified psychiatrists currently employed by WA Health received
training in relation to their legal obligations under the Mental Health Act;
and, if not, why not?
(4) Is a legal officer employed in the Office
of the Chief Psychiatrist to provide advice to the Chief Psychiatrist and
psychiatrists employed by Western Australia Health as to their legal
obligations under the Mental Health Act; and, if not, who provides such advice
and on what basis?

(1) All mental health employees of the
Department of Health, including psychiatrists, have mandatory multicultural
training, which is delivered under the leadership of the area mental health
multicultural coordinator.
(2) Psychiatrists receive additional training
from the Office of the Chief Psychiatrist that is offered and provided both on
request and as part of the continuing education programs of the WA branch of
the Royal Australian and New Zealand College of Psychiatrists.
(3) Psychiatrists receive orientation to
their service, and their obligations under the Mental Health Act form part of
this. In addition, supervision is provided by the clinical director of the
service, and there is regular peer review.
(4) No legal officer is employed by the
Office of the Chief Psychiatrist as the Department of Health has a legal and
legislative service section which provides advice as requested by the Chief Psychiatrist.
The state government State Solicitor's Office is also called upon to
provide advice from time to time.
