In relation to the advertised Perth Waterfront Amendment Report which closed on 27 May 2011, I ask:
(a) why has the Minister failed to reveal the results of the submissions to this hastily prepared report;
(b) what is the status of the Western Australian Planning Commission (WAPC) advice regarding the legality of the waterfront project, in light of the August 6 edition of Perth Voice, where the WAPC submissions chair is quoted as saying concerns raised by a respected town planner about the ability of the Government to undertake amendments would be referred to a lawyer; and
(i) will the Minister table that advice;
(ii) if not, why not; and
(c) does the Minister have any ethical concerns regarding the concurrent advertising of the Environmental Assessment Report requiring separate submissions from stakeholders?

(a) The Report on Submissions on the Perth Waterfront MRS amendment was made publicly available after notice of the Governor's approval of the amendment was gazetted on 14 October 2011.
(b) The Department of Planning has received advice on the legal matters raised.
(i) No.
(ii) It is not appropriate for legal advice of this nature to be tabled in Parliament.
(c) No. There is no legal requirement for public consultation on an Environmental Assessment Report; this report was concurrently advertised to provide a full suite of information for the community's reference and input.
