These regulations amend the Transfer of Land Regulations 2004 to mandate the use of Electronic Lodgment Networks (ELNs) for certain registry instruments, including mortgages, transfers, and caveats. It also provides exemptions for self-represented parties and situations where multiple instruments are lodged simultaneously.
Landowners, mortgagees, and conveyancers are affected. Most transactions involving mortgages, transfers, and caveats must now be lodged electronically via an ELN. Exemptions exist for self-represented individuals (with limitations) and complex transactions. The Registrar has the power to grant further exemptions.
