MA404 WESTERN AUSTRALIAN MARINE ACT 1982 WAMA—2025—207962 Exemption from compliance with speed restrictions for power yachts participating in Yachting Western Australia Power Yacht Time Trialling events I, Graeme Meinema, Director Waterways Safety Management, Department of Transport and Major Infrastructure (the Department) and delegate of the Chief Executive Officer, acting pursuant to the power in section 115A of the Western Australian Marine Act 1982 (“Act”), hereby exempt a person who is navigating a vessel that is participating in or supporting a Yachting Western Australia (Inc.) Power Yacht Time Trialing event from the application of— 1. Regulations 48(a) and 48(c) of the Navigable Water Regulations 1958 (the Regulations); and 2. The following orders made under section 67 of the Act— a. TR401 as published in the Government Gazette on 18 March 2003 limiting speed for the Swan River; and b. MA402 as published in the Government Gazette on 31 March 2017 limiting speed for the Swan River. The exemptions are subject to the following conditions— 1. The event is listed on the Australian Sailing WA Coastal Calendar; 2. The event is listed on the Aquatic Calendar published on the Department’s website; 3. The event has been approved by the W.A. Aquatic Council Incorporated; 4. Any navigation by the person on any particular day takes place only after sunrise and before sunset; 5. The person adheres to all applicable aspects of the document titled “Australian Sailing, Yachting Western Australia, Risk Management, Australian Sailing—Western Australia, Correct as at 19 May 2025”; 6. The organiser of the event is satisfied that enough suitable rescue craft are available throughout the duration of the event; 7. The organiser of the event is satisfied that suitable medical resources, including evacuation and communications resources, are in place throughout the duration of the event.
