PL405 PLANNING AND DEVELOPMENT ACT 2005 METROPOLITAN REGION SCHEME AMENDMENT 1438 (STANDARD) Sawley Close Urban Precinct Notice of Approved Amendment File: RLS/1137 The Minister for Planning and Lands has approved, as advertised, the abovementioned amendment to the Metropolitan Region Scheme (MRS). The amendment is shown on Amending Plan 3.2862 and is effective on and from the date of publication of this notice in the Government Gazette. The purpose of the amendment is to rezone approximately 16.48 ha in Golden Bay from the Rural zone to the Urban zone and Regional Open Space (ROS) reservation in the MRS. The proposed amendment will facilitate future residential development, Public Open Space (POS) and a conservation area. By virtue of section 126(1) of the Planning and Development Act 2005, the City of Rockingham Town Planning Scheme No. 2 is amended to give effect to the reservation(s) included in MRS Amendment 1438 (Standard). Pursuant to section 126(3) of the Planning and Development Act 2005, the Western Australian Planning Commission (WAPC) has the option of concurrently rezoning land that is being zoned Urban under the MRS, to a zone which is consistent with the objectives of the Urban zone in the corresponding local planning scheme. In this respect, the WAPC resolved that the land being zoned Urban within MRS Amendment 1438 (Standard) be transferred to the Development zone in the City of Rockingham Town Planning Scheme No. 2. This amendment to Town Planning Scheme No. 2 is effective on and from the date of publication of this notice in the Government Gazette.
