Made by the chief psychiatrist under section 525(e) of the mental health act 2014; sexual behaviours • sexual contact, sexual harassment and sexual assault including— • any sexual activity/behaviour (including sexual touching), between persons who are over the age of 16 years; have consented to the sexual activity/behaviour; and are believed to have capacity to consent, that occurs at a hospital (including the emergency department and the hospital grounds) or other place, including— o any place at which a community mental health service conducts assessments or examinations or provides treatment and care, including the person’s home; and o a private psychiatric hostel. This order comes into operation on the day on which this order is published in the gazette.
